Breach of Written and Oral Employment Contracts
Sage v. Sheppard (Los Angeles, CA)
Plaintiff claimed breach of oral and written contracts pertaining to her long term managerial position with Defendant, including a promise to give the Plaintiff either equity in the company or a ‘phantom-equity’ interest that would give her a percentage of the sales price of the firm. Two top managers agreed to continue their employment through sale of the company, the Plaintiff did not. The two who stayed were paid $600,000 each for their loyalty.
All causes of action except breach of written agreement were removed from the case by summary adjudication. The demand was $600,000. The Plaintiff declined an offer of $100,000.
Result: Defense. $7000 cost bill paid by the Plaintiff.
